1. Provider and scope
These terms and conditions apply to orders placed through the Vincent van Dog online shop at www.vincentvandog.art.

The offer is directed exclusively at consumers. A consumer is any natural person who enters into a legal transaction for purposes that predominantly cannot be attributed to their commercial or independent professional activity.
2. Product and personalization
Vincent van Dog uses automated image processing to create a personalized art portrait from a dog photo uploaded by the customer. Before ordering, the customer can review the portrait versions made available in the configurator, submit an eligible revision request where offered, and select and approve one version.
The subject of the order is the personalized product described in the relevant product offer with the options selected by the customer. The product description and the information displayed in the cart and checkout at the time of ordering are decisive. Items not expressly identified as included or as a product option are not part of the delivery. A digital image file is included only where the product offer expressly says so.
3. Requirements for uploaded content
The customer may submit only photos and revision requests that may lawfully be used. In particular, the customer confirms that:
- they took the photo themselves or hold the rights required for processing and producing the personalized product;
- the use does not infringe copyrights, personality rights, data protection rights, trademarks or other third-party rights;
- the photo does not show identifiable people;
- the submitted content is not unlawful, offensive, discriminatory, glorifies violence, pornographic or otherwise prohibited; and
- they will not circumvent technical safeguards, usage limits or security measures.
We may reject unsuitable or prohibited uploads and revision requests. Automated checks can make mistakes. If you believe a decision was incorrect, contact mteipel@outlook.com.
For the duration of contract performance and the retention periods described in the privacy policy, the customer grants us the necessary non-exclusive rights to technically reproduce and edit the uploaded photo and information and to have them processed by our appointed service providers where necessary for image screening, portrait creation, previewing, production, shipping, complaint handling and security.
4. Preview and approval
The preview contains a watermark and is intended for selecting the image. The customer must expressly approve the desired portrait version before adding it to the cart.
Before placing the order, the customer must check the selected version, format, finish, delivery address and all other order details. The portrait version technically linked in the cart and approved by the customer is the version produced.
Screens, device settings and ambient light can display colors differently from the manufactured product. Minor, technically unavoidable differences between the on-screen preview and the product are possible. Statutory rights in the event of material differences or other defects remain unaffected.
5. Formation of the contract
The presentation of products in the online shop is not a binding offer but an invitation to place an order.
The customer can correct input errors before ordering using the controls provided in the shop and checkout. By pressing the final button that indicates an obligation to pay, the customer submits a binding offer to conclude a purchase contract for the personalized goods in the cart.
Receipt of the order is confirmed electronically. The purchase contract is formed when we expressly accept the order, send an order confirmation or begin production. If the offer is not accepted, any payment already collected will be refunded without undue delay.
The contract is concluded in German. Shopify stores the contract text within the applicable legal and technical requirements. The customer receives the order details and these terms by email and can save or print them before ordering.
6. Prices and payment
The total price displayed in the shop and checkout at the time of ordering applies. All prices shown to consumers are final prices and include taxes required by law. Any additional shipping costs are displayed in the shop or checkout before the order is placed.
The payment methods available in checkout are processed by Shopify or the payment provider identified there. The terms of the selected payment provider also apply. We may make production conditional on successful receipt or confirmation of payment.
7. Production, delivery and shipping
We deliver to the destinations available in the shop or checkout. The delivery time stated in the product offer or checkout at the time of ordering applies.
Delivery times may be extended for reasons outside our immediate control. We will inform the customer of material delays as soon as they become apparent. Statutory rights in the event of delayed delivery remain unaffected.
For consumers, the risk of accidental loss or deterioration passes only when the goods are handed over to the customer or an authorized third party designated by the customer. This does not apply where the customer independently commissions a carrier that we did not name.
The customer must provide a complete and correct delivery address. Additional costs demonstrably caused by an address culpably supplied incorrectly or incompletely by the customer may be charged where permitted by law.
8. No right of withdrawal for personalized goods
The product is manufactured for the customer only after their individual selection and approval. Under Section 312g(2)(1) BGB, there is generally no statutory right of withdrawal for goods that are not prefabricated and whose production is governed by an individual choice or decision by the consumer, or that are clearly tailored to personal needs.
A withdrawal or return solely because of dislike or a change of mind is therefore excluded. Statutory rights in the event of defects, transit damage or incorrect delivery remain unaffected. Details are set out in our cancellation and refund policy.
9. Warranty rights and complaints
Statutory warranty rights apply. For a valid defect claim, the customer may first request subsequent performance. We generally offer a replacement product at no additional cost. If subsequent performance fails, is impossible or unreasonable, or is not provided within a reasonable period, the customer has the further statutory rights.
The customer should report visible transit or production damage as soon as possible to mteipel@outlook.com and include photos of the product and packaging. This request is not an exclusion period and does not restrict statutory rights.
10. Rights in the photo, portrait and shop content
Rights in the uploaded source photo remain with the relevant rights holder. We do not acquire ownership of the source photo through processing.
Upon full payment, ownership of the delivered physical product passes to the customer. To the extent that transferable usage rights arise in the individually generated design and are held by us, the customer receives a simple, perpetual and worldwide right to use, display and give away the delivered product for private, non-commercial purposes. There is no entitlement to the digital production file.
Automatically generated images may contain stylistic features similar to other results. Exclusivity in the artistic style or general visual elements is not owed.
Texts, trademarks, layouts, sample images and other shop content may be used without permission only to the extent permitted by law. Third-party rights, particularly in licensed sample images, remain unaffected.
11. Availability and technical disruptions
We aim to provide a reliable shop and portrait configurator. Continuous, uninterrupted or error-free availability is not owed. Maintenance, security measures, disruptions affecting Shopify, Microsoft Azure, payment or communications services, and force majeure may cause temporary restrictions.
If creating or ordering a portrait becomes permanently impossible, the order cannot be completed. Payments received for orders that cannot be performed will be refunded. Mandatory statutory rights remain unaffected.
12. Liability
We are liable without limitation for intent and gross negligence; culpable injury to life, limb or health; under the German Product Liability Act; within the scope of an accepted guarantee; and in all cases of mandatory statutory liability.
For a slightly negligent breach of an essential contractual obligation whose performance is necessary for proper execution of the contract and on whose compliance the customer may regularly rely, liability is limited to the foreseeable damage typical for the contract.
Otherwise, liability for damage caused by slight negligence is excluded. These limitations apply correspondingly to our legal representatives and agents. Statutory consumer rights remain unaffected.
13. Data protection
Information about the processing of personal data, Shopify, Microsoft Azure, AI-assisted image processing and deletion periods is provided in our privacy policy.
14. Consumer dispute resolution
We are neither willing nor obliged to participate in dispute-resolution proceedings before a consumer arbitration board.
15. Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the country in which they have their habitual residence.
The statutory places of jurisdiction apply to consumers.
16. Final provisions
If an individual provision of these terms is or becomes wholly or partly invalid, the validity of the remaining provisions is unaffected. The statutory provisions take the place of the invalid provision.
Changes to these terms apply only to future orders. An order already placed is governed by the version incorporated at the time of ordering.
